DOJ barred Apple from telling them at time but 3 years later in May '21 Apple told them. One last thought from me today (violin is infinitely more enjoyable than Brexit). Johnson & Co's belief that any form of internal trade barrier is incompatible with the existence of sovereignty and territorial integrity must come as a shock to dozens of states around the world...
Johnson's latest dishonest & antagonistic bumblings suggest UK has little intention of respecting international & domestic legal obligations to respect Protocol. But threat to suspend Protocol using Article 16 safeguard clause has (at least) one rather fatal flaw. Here it is:
UK Foreign Secretary openly accuses EU of putting Good Friday Agreement at risk by expecting Protocol to be implemented. Not just inflammatory. Since HMG proposed & signed + Parliament approved that very Protocol, he is in fact admitting that UK plotted to undermine peace in NI.
I wonder whether, when meeting President Biden, the unelected cronycrat David Frost engaged in his usual tactic of both encouraging loyalist agitation over the Protocol and then instrumentalising the consequent threat of violence in an attempt to justify the UK's illegal conduct?
Weird how Frost just wants things in NI to "get back to normal". Sorry, Frost, but your Hard Brexit changed everything for NI and your Great Brexit Deal means there is a new normal - one where NI is segregated from GB. All so you can have your wee trade deals in the Pacific.
A serious question for my UK law colleagues:
By refusing properly to implement the NI Protocol, is HMG acting in breach not only of EU-UK withdrawal agreement as matter of international law; but also of EU (Withdrawal) Act 2018 as matter of domestic UK law?
Here's why I wonder:
